The Operator Agreement.

This Operator Agreement is a legal contract between you (the “Operator”) and Kixik Technologies LLC (“Kixik,” “we,” “us”). When you sign up for Kixik, you agree to these terms. If you do not agree, please do not sign up.

Kixik builds and maintains a working simulated copy of your business — your “Twin” — and lets you submit decisions to be tested through it as “Simulations.” We deliver a written report — a “Verdict” — for each Simulation. We provide this service on a subscription basis.

Kixik is a rehearsal service, not a forecast service. We do not predict the future. We surface what your Sample of simulated personas suggests is likely to happen across a range of scenarios. Verdicts are intended to inform your judgment, not replace it. You make the actual decisions for your business. Kixik does not.

You select a tier at signup:

• ◆Spark: Free 3-day trial, no card required.
• ◆Founder: $49 per month, or $490 annually.
• ◆Founder Pro: $79 per month, or $790 annually.
• ◆Operator: $149 per month, or $1,432 annually.
• ◆Director: $499 per month, or $4,790 annually.
• ◆Boardroom: custom engagements from $9,995, billed per separately negotiated MSA.

Monthly subscriptions bill every 30 days. Annual subscriptions bill once per year and provide approximately 17–20% savings versus monthly. All billing happens through Stripe.

You can change tiers any time. Upgrades take effect immediately and are prorated. Downgrades take effect at the next billing cycle.

30 days on us if you don't like it. If within your first 30 days on a paid self-serve tier you are not satisfied with our work — for any reason, your reason — send us one email or in-app message and we refund the full month within 3 business days. No questions, no escalation, no retention call.

The Promise applies once per Operator across the lifetime of the relationship and to all monthly self-serve tiers (Founder, Founder Pro, Operator, Director). After the first invocation and refund, future months bill normally and the Promise no longer applies. (If you re-subscribe after a Promise invocation, we will honor the Promise again on the new first month within 90 days as good-faith re-entry.)

The Promise does not apply to Boardroom engagements (one-off custom engagements), which have separately negotiated refund terms in their MSA.

You can cancel at any time, one click in the app or one email. Cancellation takes effect at the end of the current billing cycle. After cancellation:

• ◆Your Twin is sealed within 24 hours of the cycle end.
• ◆You retain read-only access to all your prior Verdicts and your Twin's Sample composition for 12 months.
• ◆After 12 months, your Twin and all associated data are permanently deleted.
• ◆If you reactivate within 12 months, your Twin resumes where it left off (with a free re-conditioning update).

We do not require a phone call to cancel. We do not have a retention team that calls you. When you cancel, we say “until next time” and let you go.

Your data is yours. We are stewards.

• ◆You retain full ownership of all data you provide to Kixik.
• ◆We use your data solely to build and maintain your Twin and produce Verdicts for you.
• ◆We do not use your data to train or seed any other Operator's Twin.
• ◆We do not sell, share, syndicate, or repackage your data for any third party.
• ◆Sub-processors (companies we use to operate the service) are listed publicly at kixik.com/sub-processors.
• ◆You can request a full data export any time. We deliver within 7 business days.
• ◆You can request a hard-delete of your data during cancellation. We confirm and execute within 24 hours.

Everything you tell Kixik about your business is confidential. We treat your business decisions, your customer data, your team, and your Verdicts as if they were our own.

Specifically:

• ◆Kixik staff with access to your data are bound by confidentiality obligations under their employment terms.
• ◆We never publicly disclose that you are an Operator. (You may, of course, disclose that you use Kixik.)
• ◆We never compare you to another Operator, share insights from your Twin with another Operator, or write public content about you without written consent.

Anonymized, aggregated insights — drawn across many Operators with no identifying details — may appear in our public writing (e.g., the State of the Operator note). These never reveal anything specific to your business.

By signing up, you agree not to:

• ◆Use Kixik to plan or execute illegal activity, discrimination, or harassment.
• ◆Use Kixik to manipulate financial markets (insider trading, securities fraud, etc.).
• ◆Use Kixik to defame any specific person or organization.
• ◆Reverse-engineer, copy, or resell any part of the service.
• ◆Provide false information at signup or about your business.
• ◆Share your account credentials with others.

If you violate this section, we may suspend or terminate your account immediately, without refund, and (where applicable) report you to relevant authorities.

Verdicts are written by Kixik with the help of automated systems, reviewed by human analysts, and signed Kixik. We strive for high quality on every Verdict.

Verdicts are based on the data we have about your business at the time of each Simulation. They are not guarantees, predictions, or professional advice. They are one input — a thoughtful one — to your decision-making.

We disclaim any warranty that a Verdict will produce a specific outcome in your real business. The Operator's Promise is the satisfaction mechanism if you are unhappy with our work.

To the maximum extent permitted by law, Kixik's total liability to you for any claim arising from or related to this agreement is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

This section does not limit liability for fraud or willful misconduct.

We may update this Operator Agreement from time to time. If we make material changes, we notify you at least 30 days in advance by email and in the app. If you do not agree to the updated terms, you may cancel.

This Operator Agreement is governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Any disputes are resolved in the courts of Travis County, Texas, or by arbitration if both parties agree.
